Lewandowski outlined the series of events that occurred on the night of November 15, 2009 for the jury.

She described how Adrian Baker, Glen Jefferson Jr. and Ronald Kelly ended up at a party at the Phi Sigma Kappa house, got into a scuffle and were kicked out.

The three men got into Jefferson car, parked in the Main Street Auto Care lot and recklessly pulled out, almost hitting Kernich and his friends.  Someone in the group shouted at the car and a fight ensued.

Lewandowski also outlined the evidence collected by the Kent Police that night, including Baker and Kelly’s shoes and clothing, as well as a videotape taken during the booking procedure of Baker trying to destroy evidence.

Michael Lear, one of Bakers three defense attorneys, focused on the unreliability of the witnesses, many being under the influence of alcohol at the time.

Lear also focused on the handling of evidence by the Kent Police.

Lear then called into question the reliability of Glen Jefferson, who has become whiteness for the prosecution.

He outlined how Jefferson wasn’t arrested and evidence was never collected although he later admitted to kicking Kernich.

The trial will resume 9:00 am Thursday morning at the Portage County Court of Common Pleas.
