Baker 22 and Ronald Kelly, 20 – both University of Akron students, were arrested and charged with felonious assault after a fight broke out just after 2:00 am on the 200 block of East Main Street in Kent November 15, 2009.
The victim, Kent State student Christopher Kernich, 23, was taken to the hospital and died six days later. Baker and Kelly were indicted for murder by a grand jury on November 30th, with bond eventually being se a $1 million in December. Glen Jefferson Jr, also a student from the University of Akron, was also arrested in connection with Kernich’s death and was charged with obstruction of Justice. More than 40 potential jurors were questioned Tuesday and Jury selection will continue through Wednesday morning. With the potential jury pool narrowed down to 50, prosecutors and defense attorneys will be limited to one hour each of questioning for the general selection process. During Tuesday’s proceedings, Baker’s defense attorneys’, Scott Michael Lear and William Whitaker jr. asked for another continuance in the case. They cited potential errors in the way the evidence was handled, more specifically citing the DNA testing. Judge John Enlow overruled the motion, explaining that delaying the trial, even another six month is unreasonable and might have an effect on the memory of the witnesses. So far it is known that the defense will be calling 25 witnesses and the prosecution will be calling 70. Ronald Kelly’s trial is slated to begin May 4th.
